Higher Court Gets Battle Over Sea

A court battle to decide who should represent Turtle Mountain in the provincial Legislature has advanced to the Manitoba Court of Appeal. Liberal Edward J. Dow, the sitting member, has appealed an order requiring him to appear for examination under the Controverted Elections Act. Petitioners McMechan and Benge claimed 45 votes were cast by improperly vouched voters. Dow won after a recount by five votes over Peter McDonald. The appeal challenges whether the act removes a sitting member’s immunity while in session. The 57-seat House currently stands 31 Conservatives, 14 Liberals, 11 New Democrats, and one Social Credit.
