Will dispute over Farnham farm heirs and two sons role

In Melbourne a court ruled on the will of John Whiting, merchant of Flinders, valued at £97,500. The settlor left Farnham farm and 250 acre paddock to two sons Marcus and Ernest to work during their lives, with remainder to five children upon death or end of the leases. The testator sold stock and leased land to others, creating questions on whether the farming provision could begin after leases end and how rents during the two year leases should be handled. The judge decided the working provision activates after leases expire, the brothers may enter then, and rents during the leases go to the residuary estate. Also noted is a bequest in the will of the late J. A. Gotoh.
