Interesting Court Case of Old Days
The Supreme Court in Sydney last Friday ruled the Government liable as common carriers for loss from a bank shipment robbed by bushrangers in 1882. The Oriental Bank Corporation sued for damages after gold and notes entrusted for carriage from Forbes to Sydney were seized by Gardiner’s gang on the Forbes to Sydney road. The government argued immunity, but the court held them responsible unless a contrary covenant existed. Durley supported the demurrer while the Solicitor-General backed the plea.
