The court ruled that the plaintiff may proceed but execution requires leave. Lord Kenyon upheld the 1794 Act's scope, noting that the defendant’s bail bond should be delivered up as the plaintiff resided abroad and returned under British protection.
Mr Justice Lawrence declared the court would grant no further indulgence for un sworn affidavits. A Rule to show cause why a defendant should not be discharged was argued by Mr Zones. Praed opposed, noting the drafting party’s possible aim to fit late court rules on affidavits to hold to bail. The decision discharged the Rule and warned against encumbering legal proceedings with improper affidavits, suggesting possible perjury actions.
