Lord Kenyon noted the rule requiring special argument cases to be entered within the first four days of the term. He urged practitioners to send paper books promptly to avoid fruitless reading and reduce costs for clients. Abig legendship complained about papers delivered to judges and urged timely submission to determine which cases would be argued.
An 18th century notice describes a man with severe scrofulous symptoms who recovered after using Dr Brodum s Botanical Syrup and Nervous Cordial. It extols the remedy s efficacy, quotes testimonials, and lists multiple outlets and agents across Oxford Street Pall Mall and other cities for purchase and orders.
An account praises Lord Duncan for provisioning his fleet before anchoring at Yarmouth Roads and sailing with limited ships to engage the Dutch. It notes stores afloat for three months and details the reinforcement of five ships, including the Raffel, as well as Captain Fairfax urging back of top sails to let others come up.
In a Jamaica to London insurance case the underwriters agreed to drop convoy restriction for ten guineas more. The ship separated, fell to a French privateer, was recaptured, and finally arrived London. The jury found for the plaintiff. Lord Kenyon held arrival occurred in voyage, not London port, and denied a new trial. In the banker’s cheque matter, Mailman and Co failed, and the court upheld the plaintiff’s verdict, discharging the rule for a new trial.
The case concerns a Banker's Cheque drawn on Down and Co. Bankers for 24441 dated February 17 1796. It was not presented until January 16 1797 when payment was refused at the Defendants' request. On November 15 1796 the Defendants sought acceptance for 2444] payable at three months, making the bill due February 18 1797. The cheque was handed to Mullman and Co. as security and later passed to the Plaintiff for value. At trial, Defendants argued the cheque resembled a bill of exchange and was long overdue when seized by the Plaintiff.
