Law Report: Middlesex Grand Juries and Sheriff’s Rule
In the Court of King’s Bench on Nov 4 two Middlesex grand juries were sworn before Mr Justice Colier. The sheriff of Leicestershire faced a writ of capias ad satisfaciendum tied to 4000 pounds. Butler Danvers and Mr Mix Gay argued. The sheriff deposited funds with the sheriff, regained liberty, and was warned not to pay the money to the plaintiff while a bill in equity against Collier and King unfolded. Lord Rexworth and Mr Justice Grose refused to grant the rule, noting sheriffs’ duty to hold funds until the equity case concludes, and feared a general indemnity precedent. Rule discharged.
