Mr Garriiy moves to be discharged from custody on a fifty common bail. The defendant, a French widow, lived in this country via prostitution. The plaintiff signed a note for "focus" on condition she would bed with him. She complied and later arrested him on the note. The application rested on lack of legal consideration. Mr Justice Buller said the Court could not decide by affidavit. Lord Kenyon warned this could become a viable defence at trial.
