Warranty of Ship Failure With Convoy Case Before Lord Kenyon

In London, July sittings before Lord Kenyon and a merchant jury examined whether a ship owner’s warranty that a vessel would fail with convoy bound the insurer and whether the Cromer actually failed with convoy. The plaintiff, owner of goods valued at 1476l 16s 0d, claimed insurance reliance on the warranty and argued brokers acted as ship owners’ agents. Lord Kenyon ruled on two questions: existence of a warranty to fail with convoy and if the ship did so, whether failure occurred, affecting liability to insurers.
