Playdel v Earl of Dorchester Damages on Water Diversion
A civil action brought by Playdel against the Earl of Dorchester for damages after a water diversion damaged his estate, mill, and canal. The jury awarded 20001, but a Rule to set aside the verdict for a new trial was granted and made absolute. Lord Kenyon urged justice and equality before the law, urging that the scales of justice be even between rich and poor. The decision held the Rule for a new trial absolute, citing uncertainty in quantum of damages and the need for proportionality to property value.
