Abel W Potts vs Abel on Policy for Freight in Guadeloupe Case

In Guildhall London on December 20 the case Abel W Potts on a policy to recover freight for a neutral ship Elizabeth from Bourdeaux to St Thomas was argued. Counsel for defendant argued the action was not maintainable, while plaintiff pressed for a case to be submitted to the Court of King’s Bench. The ship arrived at Guadaloupe and cargo was restored, though later the cargo was taken by order of government and proceeds returned to the captain, leaving freight due only for the voyage to Nevis without reversal of demnation. The judge reserved opinion and ordered the facts to be drawn from Lordship’s notes, with no freight due if the voyage ended before reaching destination.
