Law case on market rights and fishery restrictions under old deeds
In a lengthy Highland court discussion the Lord Prayers judgment deals with market rights vested prior to 1882, the closure of markets for a fishery, and alleged undue interdicts. Defenders contest the market’s boundaries, arguing public roads and market ground extend to include adjoining streets, while the pursuers seek to preserve market access and prevent disruption to fishermen and vendors. The case references a market house, public convenience, and prior precedents, with consideration of damages and injunctions. The decision touches on vested rights, public utility, and the powers of municipal authorities over market spaces.
