Important Commercial Trial Foley versus Fogarty

Lord Chief Justice Bushe presided at Clormel over an assimpsit action. Thomas Foley of Farbour Grove Newfoundland sued Richard Fogarty of Waterford for 5000 pounds damages alleging misappropriation of funds. Fogarty kept two sums 20041 10s 2d and 671 8s 3d in his name for Foley, later bank failure left Foley seeking accountability. Verdict for Foley at 9471 8s 3d with liberty to receive Newport estate dividend. Points of law reserved by both sides.
