FOR TRIMARCHI o-Court Refuses Motion of Restaurant Man in Beer Sale CaseH'.ImCharles Trimarchi, West Philadelphia Street restaurant proprietor, must appear before President Judge E, E. Creps In Criminal Court June 20 for sentence on a charge of selling beer to a minor.Judge Crisps so ordered in an opinion' handed down late yesterday in the appeal of Mr, Trimarchi for a new trial following his . conviction by a'.jury''last March 19, The motion was based on remarks made by District Attorney Edwin M. Clark in his opening address to the jury, the defense contending they •had been prejudicial.The court reviewed the testimony and the opinion pointed out that no written record had been made of the remarks but that the defense contended Mr, Clark had said the coroner “recommended this prosecution” while the district attorney said his remark to the jurors had been that the coroner “recommended this investigation.” The court said the coroner had recommended an investigation of the-, sale of beer to James Shockey, of : Apollo, and a companion, K. O. Burkhart, when aninquest was .held into the death ofMr. Burkhart, who was fatally., injured Oct. 1, when Mr. Shockey and he were driving home from Indiana and their' car was wrecked. The court said the . defense in the' trial had mentioned the wreck and. had not objected to testimony concerning Mr, Shockey's companion.The court said: “we are satisfied that the defendant was not prejudiced pnd that he had a fair trial/'M •
