Lewis’ Conviction Upheld on AppealThe court of criminal appeals Wednesday affirmed a conviction carrying a death sentence, another carrying a life sentence, and reversed a former ruling to affirm three convictions carrying fines for sales of horsemeat for human consumption.Felix Lewis of George West facta the death sentence under a Live Oak County conviction for rape of a 16-year-old girl last May 20 Tha anpealate court said it found no reversible error In the trial court proceedings.The life sentence was given Sala-theal H T. Everhart of Dallas for murder in the baseball bat slaying of Brady Johnson Dec. 18 1948.in Dallas The appealate court said it could find no error in the case.A fine of $150 against L. R. Neill and two fines of $200 each againstC. F Phillips, both of Tyler, forsale of horsemeat for human consumption were reinstated under tha appeals court's new ruling in tha casesEarlier, the appeals court had held that bacause Neill and Phillips were convicted under a law repealed by the last legislatura their convictions would not stand. But the appeals couTt. on motion for rehearing by the state, said Wednesday that the new law substituted for the old one by the legislature provided for convictions under the earlier law to stand The court withdrew its earlier opinion in tha cases and substituted the new one.
