Herget Named foreman by CourtThe investigation into so-called ‘county liquor courts” and their method If collecting fines, which was not completed by the October grand jury, will be taken up by the January grand jury, of which the Rev. John F. Herget, pastor of the Ninth Street Baptist Church, will be foreman. Dr. Herget and a number of other '''prominent Cincinnatians have been summoned for service on tlve jury by Judge Roettinger, who appointed pr. Herget foreman.In its final report to Judge Cald well in Criminal Court yesterday the October grand jury suggested that the matter again be taken up by the January grand jury.• “We fully agree with the suggestion of the last grand Jury tiiat this matter be referred to the State Legislature, which will be in session next month, for such action as It deems necessary,” the grapd jury report stated.The body had been in session 53 days, in which time it examined 39 4 withnesses and returned 121 indictments. Seventy-six cases were ignored.Conditions in the county jail, w hich have^been the subject of much discussion, were said to be excellent and the food wholesome, by the retiring gjand jury. fQllowing ^ thorough investigation.Among fifteen indictments returned by the grand jury in its report to Judge Caldwell, two charged manslaughter. One of the manslaughter indictments named William Rosenthal,/ Jr.. in connection with tlje killing/of Mrs. Louisa Fox. *3 years old, of Springdale, pike, on November 1, 192 4..Custard Fie as Clew.Rosenthal, ii is alleged. was arrested shortlw after the accident, wrhen pieces af a custard pie were found clinging to the fronf of the radiator of hil auto. Mrs. Fox had lleen carrying? a custard pie when ©fee was killed by an auto wlilfch failed to stop. Rosenthal denies that he struck the woman.Max Bf Soloway ‘of* 4 37 Wade street was named in the other manslaughter indictment. It is alleged that his auto struck and killed Leroy Brew er, C A*ears old, of 719 West Xinth street, on October 9, 1924.Dan Dean, auto salesman and former star pitcher of the Winchester (Jvy.) baseball team, was indicted on a’charge of embezzling $284 from Miss Harriet Stinger, an official of the Pogue Company, on January 11, 19 24. In an auto trade.Frank Xeuhauer, now serving an indeterminate sentence In the Ohio Penitentiary on a charge of robbing Erwin Schneider, an official of the Schneider Grocery .and Baking Company, in Norwood, is named * jointly with his brother, Edward Xrmbaucr. In an indictment eharg-t\w robbery. It Is alleged that the two brothers held up Owen Arms, a collector for the Kroger Company, in Price Hill and robbed him of $344.50 on August 27, 1924.Another indictment returned charged Edward Neubauer with robbing Thomas McHugh of 2548 Trade averiue of $1,019 at Sixth street and Mt. Hope road- McHugh was a collector for the People’s Packing Company,* 125 Elder street. When arrested by detectives following the robbery., Neubauer is said to have had a book containing the names and exact tijrfes a£ whidh collectors for nine large local firms made their roundsIndictments Returned.The follownig indictments also were returned:John Iiillington, burglary and larceny; Roger Johnson, robbery; Robert Resbore. attack: Harris TlKrrfTajT and James McCoy, burglary, larceny and receiving stolen goods: George W. Hild, failure to provide.The grand jury ignored a first-degree murder- charge * preferred -against Simon Whittington. 30 years old, negro newf vendor, of 612 Jane street, for the mtirder of John Ifeheman, 2 0 years old. of 46 39 Stanton avenue, star athlete of the Purcell Athletic Club, on the morning of November 5, 192 4.Hehcman, according to the police, was shot and killed by Whittington during an argument which followed an attempt of Heheman and several other youths—members of the Purcell Club—to enter Whittington's home. Whittington contended he shot in self-defense.Robert Kelly, James O’Keefe and Harry Breen, companions of Heheman. told police they entered Whittingtons premises by mistake, They said they had attended a banquet at Tower,Hill on the previous night in honor of the baseball team of the Purcell Club and had visited the West End in search of “home brew.
