Court ruling over bond on illegal distillery venture
In Trespay the Court held that the bond for 10,000 could not support a claim since its condition precedent required forming a 10 000 share Patent Distillery Company and securing payments by 9 000 shareholders. The patent’s terms voided by illegal corporate acts under which the bond’s target acts would amount to fraud on investors.
