Mr; ofDnnmore. lieutenant and governor of the province and colony of Virginia. This ie the tract, where MbsShow nee la located.The deed was in legible handwriting and signed by J. W. S. More. Notea on the deed cover were:“Montgomery Court Book D, pace 9. June 1. 1790; Hugh Tune* to George Fearis, 400 acres; Mitchell Clay to fiforge Pearl*. 403 acres ” The conveyance S* headed as follows:1 King Heorge the III by John. Karl of Dunmor*. lieutenant and governor of the province and colony of Virginia; H03 acre* of land at Clover Bit tom. on Bluestone creek, a brvnrh of New river, to Mitchell Clay, assignee of Lieut. John Draper. Fm-county. Surveyed April 23, 4, hv Daniel Smith, assistant to William Preston, surveyor of Fin-county.” A detailed hand-druwn map appears on the bark pace of the deed.The opening paragraph read* asfollows:“George the Third, by the Grace of God. of Great Britain. France and | I-eland King, defender of the faith, vcc to all to whom these presents glial! come: Greeting. Whereas hyone royal proclamation, dated atSaint James, the seventh day of October. one thousand seven hundred and slxty-thrae, in H»* third year of our reign, for regulating the Sessions made to ua in America by the treaty of peace; We command and empower our governors of our several provinces In North America to grant without fee or reward to such reduced officers as had served In North America during the late war. and to such private soldiers as had been or should he disbanded in America, and are actually residing there, aud should personally apply for the same. certain quantities of land, subject at the expiration of ten years to the same quit rents as other lands are subjected to, and It being sufficiently proved to our Lieutenant end Governor of our Colony and Dominion of Virginia, that John Draper, late a iieuenant In the service of this colony is entitled to two thousand acre* of land under our royal proclamation aforesaid 803 acres part thereof the said JohnDiaper hath assigned unto Mitchell Clay, etc.”The deed provided that Clay would have his due share of all veins, mines and quarries, discovered and undiscovered, within the bound-arie* the river and aeveral watercourses therin contained, together with the privileges of hunting, hawking. fishing, fowling and all the otherhereditaments to the sameThe consideration was that Clay, and his assigns forever, pay to the conveyor, “heirs and successors, for every fifty acres of land, and lt;*o proportionally for a lesser or greater quantity than 50 acres, the fee rent of one shilling yearly, upon the feast of Salni Michael the Archangel, next after ten years from the date of thee* presents, and also cultivating and improving three acres part of every fifty of tract above mentioned withinthree years after the date of these presents; provided always that if three years of the said fee from and after the expiration of the ten years, aforesaid, shall at any time he in arrears and unpaid, or If th* said Mitchell (’lay, his heirs or assigns do not within the space of three years next coming after the date of these presents, cultivate and improve three acres of every fifty of the tract, then the estate hereby granted shall cease and he utterly determined.” The deed was w itnessed and signed at Williamsburg.
