Rothkrug, ofHillspoint road, Westport, Conn., notified his lawyer here today he would waive extradition and return to Germany to stand trial on security violation charges.The U. S. High commission court dropped charges against Rothkrug yesterday after Prosecutor Thomas C. Lancian said Rothkrug Is in, the United States and could not be extradited.*T consider £*aneian*s statement that he 1s unable to extradite me a foul blow ” Rothkrug cabled Defense Attorney Earl Carroll. To everyone concerned I say I am more than willing to waive extradition.”Rothkrug, 54, former chief of documents for a U. S. Intelligance branch in Berlin, was convicted in August 1953 of possessing top secret papers after leaving the service.He was sentenced to 11 months in prison.Rothkrug appealed.* The U. S. Appeals court Wednesday set aside the conviction and directed a new trial. The ruling said Rothkrug had been denied due process of the law because his trial had not been public.T was not available for comment.
