Civil No. 194$: 1 hereby give notice, pursuant to the order of the Honorable W. Calvin Chestnut, United States District Judge, entered in this proceeding on the 10th day of July, IS43, to the following defendants named in the petition for condemnation, as amended, filed herein, to wit: Fannie Sopher, Alfred . Nichols. John W. Nichols, S. R. Nichols, Franklin E. Nichols. Mary E. Benchoff, Clarence M. Nichols, Harvey A. Miller, ‘Edith May Miller, Frank V. Rhodes. The Potomac Edison Company, Carl H., Rasche, Ernest W. Rasche, Joseph J. Brockmeyer. Catherine H. Brockmeyer, David Bachrach. Moses Each-rach, Samuel L. O’Neal, Philip R. Uhler, Ferdinande Rasche, Bernard Janson and wife, Lavlnia R. Dutton. Pearl D. Uhler. Fannie K. Bachrach, Cecilia Bachrach:. Board of County Commissioners of Washington County; and the State of Maryland; to ail non-resident and unknown defendants: and to any and all of the unknown owners; tenants: occupants; claimants; and other persons Interested in the land and improvements proposed to be condemned in this proceeding: and any and all of the-unknown heirs; spouses: alienees: devisees; claimants; executors; administrators' assigns: or persons claiming in- the said land and improvements. Special Attorneys, Department of Justice, and that said condemnation proceeding ts now pending. I further give notice to all such parties as may be interested in the land and improvements sought to be condemned therein, or any pa.t thereof, to come forward on or before the 23rd day of August, 1943, and file their objections, if any they have to the proposed condemnation of said land for use in connection with the establishment .of a recreational center to be located in Washington County, State of Maryland, adjacent to Camp Ritchie, and for other public uses; and to set forth their several.ownerships, claims, interests .titles, estates, rights,, or liens, if any, and that • they wilv be adjudicated and forever determined by these proceedings, and that the final award for said lands, when paid into the Registry of this Court, will be disposed of. as the Court may direct in these proceedings. The said petition for condemnation recites that pursuant to certain Acts of Congress. the Secretary of War is authorized to acquire on behalf of the United; States the land hereinafter described, for a public purpose, to wit: for use i.i^connect!on with the establishment of a recreational center to . be located in Washington County', State of Maryland, adjacent to Camp Ritchie, and for other public uses. The money appropriated for the purposes and under the terms of such Acts of Congress has been allocated to the War Department for the acquisition of said land; that under and by virtue of the provisions of the Act of Congress approved February 36, 1931 (46 StaL 1421, 40 U. S. C. sec. 25Sa). and acts supplementary' thereto and amendatory' thereof, and under the further authority of the Act of Congress approved August 1. 188S, (25 Stat 357. 40 U. S. C. sec. 237), and the Acts of Congress approved October 14. 1940 (Public No. 549—76th Congress), and April 29. 1341 (Public Law 42—77th Congress), anlt; June 2S, 1941 (Publicfeet, more or less, to the place of be** ginning. C. 8pc. 171). and March 27, 1942 (Public Law oir-*-77in Congress: which Acts authorise the acquisition of land for military or other war purposes: and all other acts or parts of acts supplementary to or amendatory of the said acts, the War Department has been designated as the acquiring authority for this purpose on behalf of the United States, and that pursuant to law has ascertained that the nerel^iafter-described land is necessary for the public purpose cs aforesaid; that title to the said land should be acquired bycondemnation under judicial process, and it has accordingly' applied to the Attorney General of the United States to caune such proceedings to be commenced.
