The said petition for condemnation recites that pursuant to certain Acts of Congress, the Secretary of War is authorized to acquire on behalf of the United; States the land hereinafter described, for a public purpose, to wit: for use Li„connection with the establishment of a recreational center to be located in Washington County, State of Maryland, adjacent to Camp Ritchie, and for other public uses. The money appropriated for the purposes and under the terms of such Acts of Congress has been allocated to the War Department for the acquisition of said land; that under and by virtue of the provisions of the Act of Congress approved February 26, 1931 (46 Stat 1451, 40 U. S. C. sec, 25Sa). and acts supplementary thereto and amendatory thereof, and under the further authority of the Act of Congress approved August 1, 18SS, (25 Stat 357. 40 U. S. C. sec. 257), and the Acts of Congress approved October 14. 1940 (Public No. S49—76th Congress), and April 29. 1941 (Public Law 42—77th Congress). anlt;“ June 23, 1941 (Public Law 137—77th Congress), and January 21, 1942 (Public Law No. 409— 77th Congress) and April 10. 1942 (Public Law 522—77th Congress), which Acts authorize the acquisition of land for the establishment of re-creatlonaV-facllities in areas affected by the National Defense Program, and the Act of Congress approved July 3, 1541 (Public Law No. 150— 77th Cmgre**s, which Act appropriates funds for such purposes; and August 13. 1890 (26 Stat. 316), as amended by Acts of Congress approved JuL 2, 1917 (40 Stat 241) April 11. ISIS (40 Stat. 518. 50 U. S. C. sec. 171). and March 27, 1942 (Public Law nt7—77th Congress: which Acts authorise the acquisition of land for military or other war purposes; and all other acts or parts of acts supplementary to or amendatory of the said acts, the War Department has been designated as the acquiring authority for this purpose on behalf of the United States, and that pursuant to law has ascertained that the nereljiaffer-described land is necessary for the public purpose as aforesaid; that title to the said land should be acquired by condemnation under judicial process, and it has accordingly applied to the Attorney General of the United States to cause such proceedings to be commenced. That the land ascertained and selected for acquisition for the purpose aforesaid is situate In Washington County. Maryland, adjacent to Camp Ritchie, more specifically described as follows: TRACT NO. 1—All that certain piece or parcel of land situate. lying and being in the County of Washington. State of Maryland, and more particularly described as follows: Beginning for the sameat the intersection of the Southwest side of the Cascade-Sabillasville Road (as the same 5s now constructed and used) and the North side of the Western Maryland Railway Company right of wav and running thence with the binding on the Southwest Side 8a.Td“Road the two following courses and distances, viz:—North 35* 34* West 260 feet, more or less, and North 32® 24* West 140 feet, moro or less, to a point on said side of said Road, where it is intersected by the dividing line between the land now being described and that adjoining on the Northwest, which now or formerly belonged to the Estate of FerdI Rasche. thence South 53° 41' West binding on said dividing line 258 feet, more or less, to intersect the North right of way line of the Western Maryland Railway, above mentioned. and thence Southeasterly binding thereon by a line curving toward the left for a distance of 490.
