rihon; for defendant, Mr. Holems.In Cham nr. m—Before Judge U lshoeffer.—In re Horace Hurl but.—Thic was an application by writ of habeas corpus for the discharge of Mr. Hurlbut, on the ground ofnls being a minor when he enlisted. It appeared that on the 5th of May, 1815, he enlisted in the I niteil States army, and was sent to the depot, where he remained until the *Jdth of the same month, when he deserted and returned home to Utica, where he has quietly remained until about a week ago. in the early part of June last the government caused hand bills to be posted up in this city and in various other parts of the State. containing the names of a numbs* of persons who had deserted from the United States army, amongst which was the name of Horace Hurlbut, and offering a reward of $30 for the apprehension of each of them. On this day week he was arrested in I tica as a deserter, and hurried off to this city, and although a writ of habeas corpus was obtained there by his tathvr and other filends who followed him in tneir shirt sleeves, they were not able to overtake hint until he had arrived here, when it became necessary totsnue another writ, which was made returnable this morning. it appearing to the Judge from the testimony of his father and others, that he was not within 30 days of being of age when he enlisted, anH that lie bad deserted within that time, lie ordered him to be Uiscbaaged upon returning his bounty, paving tor his clothes, and also paving the $30 paid by the government us a reward, which being done, he was discharged.Upvitkd Utatks Marshal’* Owe r, July 2J.— Charge of Cruel and Vnutual PnnUhment.'
