Lackey withheld a decision on the Mandamus suit brought by County Clerk Rufus Hogan against the McIntosh county board of com-misioners, Monday. He tentatively continued the case until next week, but admonished the parties to get together and try to reach/ . a settlement. If no settlement is reached, then Judge Lackey said that he would render a decision when he holds court here Monday.In answering the charges brought by Hogan, the county commissioners filed a blanket denial of all allegations except those defining his duties by statute and the reduction of personnel for the clerk’s office .Hogan charged the commissioners with arbitrarily disallowing an appropriations for a third deputy in his office and setting up unauthorized expenses in the 1948-49 budget. He petitioned the court to order the eommisioners to restore the appropriation to the budget before it goes to the county excise board for final approval. .Hogan indicated a willingness to work out settlement this week, but up until yesterday he said he had not met with the board.
