'« :JSeveral weeks ago we predicted that the Union Association, to make some sort of a shoeing for their boosting, would concentrate on Muliane and carry out a system of annoying persecutions. These orders are easily obtained—the plaintiff being requfred to give bonds to fully indemnify theaccrue ifore the U. 8. District Court, where the Judge married a Lnca* arrd isnearly related to the plaintiff. Muliane came here and did not intend toitch, but a newspaper squib yester-ay indicated the contrary. The consequence was that Lucas, attorney,who had followed him here, applied, not to the U. 8. Court, but to the County CommonPleas Court, and, by giving $5,000 bonds, secured a temporary restraining order prohibiting his playing here till the case Is tried. Neither of these suits was tried, nor probably will be. Muilane to-morrow goes home wit his club, and the Toledos hope Lucas will follow him there and bring suit for injunction in that city. If he does, the ease will be triedpromptly. I* vM™-- . : '•w Muilane signed a contract with Lucas, one clause of which provided that if he should fail to report for practice in St. Louis on April 1. 1884. he would stand expelled and be ineligible to play in the Lucas Club or any Union club. Muilane did not report, and the words of the contract themselves make him ineligible to them. Again he signed for a consideration of so many hundred dollars, $500 to be paid in advance. ’This sum was paid. But Lucas re* ceived it back afterwards, and it is presumed that the Courts will hold that in doing this he granted Muilane a release. The fact that he received the advance money back can not be disputed. We have seen the check for $500 from the Toledo Club to Tony Muilane. On the back it bears Tony Mullane’s order to pay to the order of H. Y. Lucas, and right underneath is the indorsement of H. V. Lucas in blue ink. The Toledos have this check in their possession. The case is meant for one of annoyance rattier than policy. If these restraining orders should be dissolved, the bondsmen will at once be sued for heavy damage*.
