By Junior LoopActionOpenedREGINA (CP)—Legal actionhas been started to rilt;i the Canadian Major Junior Hockey T eague of its suspension by the Canadian Amateur Hockey Association and permit CMJHL teams to be eligible for this year’s Memorial Cup play-downs.A statement of claim was filed with the registrar of the court of Queen’s Bench seeking a court declaration lifting the suspension or declaring it invalid and declaring league teams eligible for the cup play-downs.The statement of claim is in the names of Frank Boucher of Regina, CMJHL commissioner;R. N, Monro, manager of Este-van Bruins,; Alex Monteith, president and manager of Wey-burn Red Wings; Donald Hutton, president of Moose Jaw Canucks; Del Wilson, manager cf Regina Pats; George Agar, manager-coach of Saskat o o n Blades; W. D. Hunter, manager of Edmonton Oil Rings and Brian Shaw, manager-coach of Moose Jaw Canucks.The defendants named in the claim are Lionel Fleury of Quebec City, immediate past president of the CAHA; Fred Page of Vancouver, president; Lloyd Pollock of Windsor, vice-president; Earl Dawson of Rivers, Man., vice-president and Gordon Juckes of Melville, Sask,. execu-tive-director.- - • •. • •Following filing of the statement of claim by Robert Kohaly, an Estevan, Sask. lawyer, the next, step would be for Mr. Kohly to serve each of the defmdants with a; copy of the claim.'- It is expected that following this step he would ask the court of Queen’s Bench-to have the case heard at ah early date because of the request that CMJHL teams be declared eligible for this year’s Memorial Cup play-downs.The CMJHL was organized last summer. CAHA said the league was not acceptable and subsequently issued an order saying persons concerned in the 3-league were suspended.The claim states the action is being taken on behalf of all concerned in the CMJHL including players who were suspended.
