This is just a contract dispute and it is a contract with ambiguities, and things in the contract are difficult to set out, Graves said.Graves said court proceedings on Wednesday were “tedious but necessary.”Irving Brenner, London’s attorney, said, “He (Hedrick) told Action Performance not to talk to Gray about what the car looked like or in the car’s marketing and advertising because they wanted to gain an unfair advantage in this lawsuit andnot support his rights to the car.”He said DEI was “mad” about London’s lawsuit and subsequently cut him out of production of the car.Brenner said he was pleased with Wednesday’s proceedings.In other testimony, Don Hawk, former DEI president, said under the contract, Action Performance was to make three model cars not one.The other two cars to be made were driven by London, with a young Earnhardt serving as crew chief. ■Hedrick said in his testimony, Action Performance would not manufacture and sell the other two vehicles.One juror was admonished by Judge Richard Boner on Wednesday for speaking to London.The juror said he and London briefly discussed medication as they entered the courtroom. The judge told the juror not to speak to any party involved in the lawsuit.The trial resumes at 9:30 a.m. today. Dale Earnhardt’s brother, Randy, is expected to testify.
