Civil Rights Act Lawsuit Is Filed At Little RockLITTLE ROCK, Ark. (L'PI)— A lawsuit based on the. civil rights act was filed in federal court Wednesday asking that the cafeteria in the basement of the state capital be ordered to serve Negroes.The suit was in the name of Ozell Sutton, a Negro. He is associate director of the Arkansas Council on Human Relations but is on leave to direct a Negro voter registration drive.The suit was the first in the state under the civil rights act. It named the Capitol Club Inc. as defendant,Sutton entered the cafeteria July 15, before it became a private club, but was refused service by Mrs. S. E. Tyler, operator of the cafeteria under a lease from the state, the suit said.Operation of the cafeteria as a private club is a subterfuge seeking to do indirectly what cannot be done directly, Sutton said.The club was incorporated July 21. Its president is Clarence R. Thornbrough, executive secretary to Gov. Orval Fau-bus.Membership in the club costs $1 a year. It is open to state employes and others approved by the corporation officers.
