Taken Up in the District Court—Grand Jury at Recess—Court News. A large number of the population of Benton township and the north part of Burlington township are in the city today to attend the district court, where this morning the case of Eliza beth O. Walker vs. Margaret Walker was taken up for trial before Judge Smythe on a question of law as to an inheritance from the late Silas Walker and his son Martin Walker. It is in many respects the most peculiar and complicated lawsuit that has been tried in the Des Moines county district court for many years. Silas Walker, the husband of Mrs. Elizabeth O. Walker, was drowned in the Mississippi river a year ago, to gether with his only son and heir, Martin Walker. Under the law of in heritance in Iowa, in case of death of all direct heirs to property excepting the widow, the property is equally di vided between the widow and the sur viving parent of the deceased. In this case Silas Walker is survived by his mother and by his widow, with no other direct heirs. His widow, Mrs. Eliza beth O. Walker, brings suit for posses sion of the entire estate, including a farm of two hundred acres, and she alleges two grounds for her right to in heritance, namely: That her husband expired first, in which event his prop erty would revert to the son, Martin Walker, and from him to his mother; also that the farm was originally pur chased with her money. Mrs. Silas Walker is represented in the case by Mr. W. W. Dodge and A. H. Stutsman, and the senior Mrs. Wal ker has for her counsel Blake Blake and Smythe Seward. The case will occupy the entire week. The grand jury adjourned last Saturday until to morrow afternoon at 2 o’clock. It is not likely that a report will be made to the court before the latter part of the week. The petit jury is called for Monday, September 30th.
