Notick of mortgage sale.—Default Raving been made in the conditions of a certain mortgage, duly executed and delivered by Judd P Hedges, mortgagor, to D. S. H. Johnston, mortgagee, bearing date the 18th day of April, A. 1). 1882, and recorded in the ottlce ot the register of deeds of Richland county, Dakota territory, on the 8th day of May, A. D. 1882. at 2 o’clock p. m., in booV 44 li ” of mortgages, on pages 405 to 407. and there is claimed to be due and there is due at the date of this notice the sum ofSeventy-Kightand 85-100(§78.35) Dollars, and no action or proceeding at law or otherwise having been instituted to recover the debt secured by said mortgage, or any part thereof: Now therefore, notice is hereby given, that by virtue of a power of sale contained in said mortgage, and pursuant to the statute in such case made and provided, the said mortgage will be foreclosed, and the premises described in and covered by said mortgage, viz : The south-west quarter(sw'i) of section thirty-two (32) ot township one hundred and thirty-four (134) of range forty nine (49) in Richland county, Dakota, with the hereditaments and appurtenances, will be sold ot public auction to the highest bidder for cash, to pay said debt and Interest, and twenty-five dollars attorney’s fee, as stipulated in and by said mortgage in case of foreclosure, and the disbursements allowed bylaw; which sale will be made by the sherilf of said Richland county, at the front door of the court house, in the city of Wahpeton in said county and territory, on the *J0th day of OCTOBER, A.
