Hearing will be held in U. S. District Court at Dallas on a writ of habeas corpus granted Dr. Harold Eidinoff, slayer of El Paso Atty. Theodore Andress, in Eidinoff’s latest effort to obtain release from Rusk State Hospi tal, where he was committed in 1959 as insane. U.S. District Judge W. M. Taylor Jr. granted the writ of habeas corpus on the reported grounds that Eidinoff has exhausted all available remedies in the State courts and therfore is entitled to hearing in U. S District Court. Dist. Atty. Barton Boling was notified of Judge Taylor’s ruling. No time was announced for the hearing. AN ATTORNEY who is famil iar with the case from its start! Said today that Eidinoff, in order to win his battle for release from the hospital, will have to pro duce evidence outweighing the expert opinions of mental health authorities at Rusk State Hospi tal — because if these authori ties considered Eidinoff sane they would have released him on action initiated by them.
