OMAHA, Oct. 22.—Charges of cross mismanagement of the $1,006,009 James E Naum estate, embracing the Baum Iron company, are made against David A. Baum, administrator, and brother of the dead man, in a peti tion filed in county court by other heirs. The pettion aswerts that through fraudulent and long-continued prac tices, David had milked the estate of hundreds of thousands of dollars, clothing his motives in secrecy which even at ifneys for the other heirs have been unable to penetrate. They ask his removal as a dysiiie trator, and that he be compel to make a strict accounting to the other heirs, and that he be forced to fe ature stocks and funds which he is alleged to atained through jJageling salary companies, Say Claims Palen Among other accusations in the “tition is the charge that David taum presented false claims against the estate, which he induced the other hetra to sign, thereby elimin ating the necessity of proof. Brought to an accounting, the fie tition alleges, he claimed that he handled the estate secretly con coil from the other heira a transac tion whereby he det¢iared James E. Baum defrauded him of certain cor porate stock many years ago, but later, according to the petition, he admitted this story to be false, and stated he was ‘trying to avoid pay ment of excessive income tax. The heirs’ who ask his removal are Otilia F. Baum, widow of James E. Baum; James EB. Baum, Jr. Prownle Elizabeth Rouse and Kath erine L. Baum. They ask that James EK. Baum; James FE. Baum, jr. be appointed administratora “de onis non” in his place.
