Application or Bond Denied.Application was made to District Judge Cole for. bail for W. P. and C. P. Tor ran s, father and son, held on a preliminary hearing without bail and now in jail at Eufaula charged with the killing of Sam Baker at Ohecotah October 7. Bail was denied by Judge Cole Tuesday night. The defendants will file a petition for a writ of habeas corpus in the court of criminal appeals.They had been committed by a justice of the peace without bail on a charge of murder, and the attorneys without resorting to the writ of habeas corpus, filed an application for bail, attaching to the petition and motion a trauscript of the evidence heard before the examining justice.E. I. O’Keilly of Eufaula, assistant county attorney of McIntosh county, opposed the motion. Finally an agreed, statement of fact was signed and filed in the court admitting that the men were in jail and that the transcript was correct.pa;AtHidetiotineffJothiresoillatCiadpu4 Torrans Held Without Bail.C. They were held without bail.In the testimony it developed that there were hard feelings between the defendants and the dead man as a result of a fight a week previous between Q. P. Torrans and Baker, in which Baker was beaten up. On the day of thekUlingitseems that Oal Freeman, a brother-in-law of Baker, and young Torrans had a fistic encounter in which young Torrans came off somewhat the worse for wear. He rau into the store of Moncrief «fe McLean and pulled his gun. At about this same time the elder Torrans and Ba-' blker were tussling front of the store, Baker getting the better of the fight. Young Torrans pushed the screen doors openand fired. Theshofcstruck Baker iu the throat and was the cause of his death. After he was shot he rau across the street and the elder Torrans fired at him but missed. Baker expired in.a few moments.. Sam Baker came to this country from Tennessee when Oklahoma was a hovyling prairie, and has been qiore or less of a “gun man,” and lias been mixed up in many a fight. He had been accused of being ift several of the mysterious? killings in this section, but nothing was eyer proven on him. At one time he \yas a deputy United States marshal under Leo E.
