ATTORNEYGENERALLES HISAFFIDAVITSGrant County Grand Jury Refuses to Act So StateWill Prosecute[INTERNATIONAL NEWS SERVICE]INDIANAPOLIS, Ind., Oct.15.—Attorney General James M. Ogden announced today that he would proceed to Marion immediately and file affidavits in Grant Circuit Court there against Sheriff Jacob C. Campbell and seven alleged mob members in connection with the lynching of two Negroes at Marion on the night ofAugust 7th.Both affidavits* will be based on the Indiana lynching- law of 1905, Ogden said.The affidavit against Sheriff Campbell will seek his removal from office and a fine of $1,000 for alleged “failure in official duties0 in failing to prevent the riot.The affidavit against; the seven alleged mob members will charge lynching and murder. The penalty for this is 2 to 21 years.THOSE WHO ARB NAMEDThose to be named in the affidavit charging lynching, Ogden said, will include:Charles Lennon, Arnold Walters,; Bob Besbire, Chester Pease, Everett Clark and two men whose last names are Boyd and Praln.Both affidavits were signed by Arthur Bruner, one of Ogden's secret investigators who has been probing the lynching.Ogden will be accompanied on his trip to Marion by his deputy, MerleWall.The state action against the sheriff and the alleged mob members comes on the refusal of the Grant County Grand Jury last Thursday to return indictments after its investigation of the riot. The grand jury gave Sheriff Campbell a clean bill stating that he acted prudently and that had he acted otherwise a race riot might have occurred.REPUBLICAN CO. CHAIRMANSheriff Campbell is the Republican county chairman of Marion county. He is also a member of Governor Harry G.
