They presented their ■bill of exceptions, in which they show fforty-eight reasons why their client should be granted a new trial, the first of which is an allegation of the unfairness against the defendant of two of the jurors, Alex. Turber and Lee Dillon. They present an affidavit signed by William N. Crabbe that in May last Turber told him he believed the preacher was guilty, that he would help hang him, and not enough evidence could be brought in to make him change his mind.Argument To Be Heard Friday*They also claim that the court erred in forty-three instances,, either in allowing certain evidence to be brought in or suppressing some which would benefit the defendant. Affidavits are also presented showing the testimony of Lennie Rushton and Eva Worrell to be false. Spaan for the state informed the court that they would insist that all persons making affi-' davits bo brought into court for the purpose of cross-examination, as an affidavit was a one-sided affair, and they wanted both sidos.
