Given Possession of the Cigar ‘Stand at 601 J Street. The case of M. Diepenbrock against E. L. Kripp for damages in the sum of $250 for forcible entry and detainer of the cigar stand in front of the latter’s place of business at Sixth and J streets, was tried before Superior Judge Johnson yesterday, resulting in a judgment for the defendant for costs, Diepenbrock vacated the cigar stand, which he rented from Kripp, on Aug ust 2d. Inasmuch as he had remained one day after the first of the month, Kripp collected a full month’s rent. On August 24th Kripp decided to reopen the stand, and was given notice by Diepenbrock that the latter’s lease had not expired, and that he proposed re opening the stand in September. Kripp disregarded the notice and opened the stand, and Diepenbrock brought suit for $250 damages, contending that he had not delivered possession of the premises, and that at the time Kripp reopened the stand he (Diepenbrock) still had possession of the cases, etc., though all of his stock had been re moved. Judge Johnson decided that the de livery of the premises was implied in plaintiff's action when he vacated them, and accordingly rendered judgment for defendant for costs.
