Walkern testified that lie had spoken to Mr Beedy sojuc time ago about thin mailer ; after some conversation about Barnard having exceeded hie authority by buying too many steamers, defendant admitted his liability for debts like the present, but asked that suit should not be brought immediately and he would see about settling; the only objection he made was that he thought behad paid more than his share of the expenses in .this colony, including (he settlement with the ^engineers, and he would like ;to get a privateaccount from Barnard, /. ^ .Messrs. Barnntou and Park, for defendant, asked for a non-suit, on the grounds that there was no case against Beedy. No partnership had been proved, nor had the agreement or compromise been produced.Mr Wuikem, for plaintiff, contended that Beedy was responsible, as a partner, for Barnard's acts. The partnership was publicly known, and a bHi had been passed through the Council on their behalf.The Court granted a^non-anit.
