C., Oct. 6.—Judge Foriu, of Nelson, arrived here at 7 :40 this evening to hear an application for the extradition of Charles H. Hinckley, uliaa Olins. A. Morris, charged with stealing $97,000 in cash from the West Hide bank iu New York city in May, 1894. The judge opened court at 8 o'clock, and couusel for the prisoner asked for his immediate discharge, as he had been illegally arrested and could not be held.The lawyer for the United States and for the bank officials asked and obtained an adjournment until 20 o’clock tomorrow morning. The lawyer for the accused stated that at the time of the alleged offence the presence extradition treaty was not in force and was net retroactive and tliat the treaty in force at the time of the alleged offenes did not cover the crime charg3d.
