Keyport Magistrate Grants Weinstein Plea To Summon Witness; Cliffwood Man Guilty Third postponement was gran ted last night in the accident case involving Michael Kidzus, of 23 Ravine Dr., Matawan, and Elihu Golden, of Atlantic St., Keyport, Aug. 14 at Broad St. ,and Maple Pl., Keyport. In granting a postponement, Magistrate Seymour R. Klein berg, of Keyport, observed it was unusual to have such a continuous delay in so relatively uninvolved a case. Leo Wein stein, of Matawan, attorney for Mr. Kidzus, explained attempts to reach no civil out-of-court set tlement had fallen through and that his client’ had come to court without a key witness, be ieving the matter would be dis missed without hearing. Edward Farry, Jr., of Keyport, attorney for Mr. Golden, agreed ‘not’ to insist’ on proceeding di rectly, and the third layover was granted. Guilty of It and Run Charge: Walter Bethune, of Cliffwood, was pronounced guilty of a hit and run charge. The Keyport magistrate consented Sept. 2 to withhold decision In the case so that the defendant’s lawyer, Mr. Farry, might file a brief. No brief having been filed, Magis trate Kleinberg rendered a de cision. In argument Sept. 2 on the accident of July 25, In which, Mr. Bethune allegedly struck a car belonging to William T. Cooney, of Newark...on~ West Front St., Mr. Farry claimed the state's case was faulty in: that the investigating officer, Patrolman John Viscont, of Key port Police, had at no time fed Mr. Bethune in with more than hitting a car, not hitting a car; of the type and make of Mr Cooney’s. The court felt the exception of dubious signifi cance, but on Mr. Farry's con tention there were cases of re cord to support such a position, agreed to withhold decision. Mr. Farry had stressed the need to file the citation of law because conviction would bring his client over the allowance in points on traffic convictions.
