WASHINGTON, November 30- - Two huge legal documents, two eight-page briefs and a 361-page compilation of Spanish and Mexican law were filed in the United States Supreme Court today in behalf of California taxpayers in the $77,000, 600 community property income tax case. The case, which involves the right of husband and wife each to file a return for one-half of the income on the property owned jointly by them has been set for argument on next Monday’s docket. The printed brief was filed by at torneys for Reuel D. Robbins, Jr., and his wife, Saide M. Robbins. “The voluntary partnership pays income tax on the just principal that taxation is co-related with owner ship,” the brief said. “One partner pays the tax on his share of the income which belongs to him, not on the share that belongs to his partner. The tax is computed for each partner upon his share. It would be so computed in the case of a brother and sister succeeding to the undivided ownership of an in come bearing property. It is so com puted by the treasury in respect to seven out of eight of community states. “Congress in two general revisions of the revenue law refused to alter the method of computation. But the discrimination against Califordia stil persists, although the highest law office of the government (the attorney general) advises to the con trary.
