InLyle Brummett, 19, will face trial Monday in 117th District Court on a capital murder charge in connection with the August death of Diane Roberts, 21.Brummett will also face a charge of aggravated sexual abuse in connection with an alleged Sept. 20 assault on a 17-year-old County Jail prisonerThe district attorney’s office has dropped sexual abuse charges against the three other inmateswho allegedly were involved in the jail incident.William Walker, who was indicted along with Brummett. pleaded guilty to two burglarymurdertrialcharges last week, and District Judge Mace Thurman sentenced him to two years in prison on each charge. The sentences will run concurrently and the sexual abuse charge probably will be dismissed.Last month Randy Leyendecker avoided prosecution on the sexual abuse charge after pleading guilty to the murder of a 12-year-old South Austin girl. The district attorney’s office dismissed the charge because Leyendecker already was serving a life sentence in prison for the murder The maximum sentence foraggravated sexual abuse is life in prisonThe third man to have the sexual abuse charge against him dropped is Johnny Richards IV. Richards went to state prison this month after his probation on a 10-year sentence for burglary was revoked. Richards was found in violation of theterms of his probation after being jailed in July on other burglary charges.Asst. Dist. Atty. David Spencer had said Richards would not be prosecuted on the sexual abuse charge because, like Leyendecker. he already is in prison.
