Cirilda A. Smith Shoots Man Following Attack An unidentified Mexican was shot and killed about 1 o'clock this after noon by Miss Cirilda A. Smith at her home, two miles west of Welton. The shooting occurred after the Mexican had threatened Miss Smith with an axe and during a struggle for the possession of a shotgun belonging to the woman, Miss Smith, who resides alone on her ranch, had been to the home of a neighbor. She was returning to her place, riding aiecce when she saw the Mexican starting a fire a few feet from the corner of her house. He was preparing to cook a chicken which he had taken from Miss Smith's ranch. Miss Smith or dered the man to leave the premises as she rode towards him. The Mexi can paid no attention to the com mand. Miss Smith dismounted from the horse and turned the animal in the corral. She returned to near where the man was starting the fire and again ordered him to leave. The Mexican then grabbed an axe that was lying near and advanced toward Miss Smith. Miss Smith ran to the house and secured a shotgun that was resting just inside the front door and leveling the gun at the Mexican ordered him to drop the axe and leave the place. The man dropped the axe and grabbed the barrel of the shotgun. Miss Smith pulled the trig ger and the shot struck the Mexican im the right breast. Then ensued a fierce struggle. The Mexican, with the blood streaming from his body, attacked the woman fiercely and the two fought through the house and back, out of doors where the Mexican fell dead. The sheriff's office was notified early yesterday afternoon and Sheriff Greenleaf, County Attorney Timmons and Judge Charles Smith went to the scene of the shooting. An in quest was held over the body of the Mexican yesterday afternoon and the coroner's jury returned a verdict of justifiable homicide. Miss Smith was not arrested
