McCormack, a Justice of the peace within anil fur the county aforesaid, James fll. Hanna, who being by me 1 duly sworn* depose*!) aixl so Mb, ihm on Whe COtb day of October a. d. 1847, the^ #% ^ i *a nti deponent was ai the hotel nf P. B-Brown in the town of Covington, and that Edward A. Hannegan of the county aforesaid, came into the bar-room of said hotel and sat down by and conversed with the said deponent upon a manor of private business, that the said deponent and ! said Ilannegan agreed to go «m of said hotel to attend to some business, that . said deponent got up and stepped lo the table to deposit a file of a newspaper thru lie bad been examining, that lie immediately heard a violent and sudden noise behind him, when, upon turning round, he saw the said Ilnnnegsn prostrated upon the floor, upon his face, and one Ezekiel McUonr.li] (as deponent is informed the individual is named) wan upon him, attempting to inflict personal injury upon said Uannegau; that said I forma pulled him off as soon as ho ascertained that was his object. Said deponent when ho first turned round upon lie a ring ibe noise, was struck with the thought that said Hannegan had been seized of an apo plectic fit, and labored under that impression until said McDonald com me need kicking said Hanucgatt irt the face, when said deponent pulled said McDonald off Said deponent would further state that not one word was passed between said Ifonncgan and McDonald before the rencounter. Said deponent would further state that said McDonald must have approached snirl Hannegan behind to attack him, (if said McDonald made the first attack,) unless the said Hannegan changed jfis position in his chair in tho very abort space of lime which it required for said deponent lo make about two steps from where ho sat io (lie table. Thai said McDonald, appeared to be laboring under violent passion, and utterly regard I ess of consequences of the violent kicks which he was inflicting on tho bend of said Hon-ncgon. That when said deponent turned from said Hannegan to approach the tabic, said Hannegan was silting with bis back towards said McDonald, rather loaning back in his chair with one leg thrown over or acro93 the other, end appeared lo be in a perfect good humor. That said Hannegan did not speak to said McDonald cither before, at the time of, or after said assault and battery aa this deponcnl believes, Tho deponent would further stale tlml he believes from all (he circumstances that said McDonald committed an assault and battery upon said Hannegan without giving him at ibe time, any notice whatever of his intention so to do.J.
