Mr. Morrell bought a piece of prop?rty in Passaic rrom Mrs. Prlee-kel, paying 911,500 for It, and nfier he had Improved 51 he found one of the Passaic dlty'a sanitary drains several feet below the surface As the transfer stated that the property waa free and clear of all Incumbrances Mr. Morrell brought suit to recover the damages done to the land by the preaeae* of the piping. The defendants Monday admitted the presence of the drain but the dispute vie overthe amount of damages that should be paid.
