Capt. James Luce Cornea in Conflict With the Town,Sometime ago Capt. James V. Luce purchased several acres of laud of Dr. McCook, lying on ths highway on the south side of Baptist Hill. It is a very due plot of ground with a magnificent view of the sound and shore for miles in either direction. It is Mr. Luce’s Intention to improve the property in various ways and to open a street through the center of it with possibly the idea of opening building lots. He has had a gang of men at work grading it where it fronts on the highway and in so doing has come in conflict with the town with the result that an injunction granted by Judge Wheeler of the Superior court, has been served on Mr. Luce restraining Mr. Luce from further work in the same line. The injunction was gotton out by the selectmen of the town.Mr. Luce has been using the earth taken from the bauk in grading and has carted it to his property near the White Beach house for filling in purposes. The opposition of the town comes from the fact that the oflicials claim that the earth in the bank bordering Mr. Luce's line on the highway .is town property aud that he is appropriating it for his own use. A few days ago Mr. Luce was ordered by the selectmen to cease operations but he failed to do so, giving as his reason that he had consulted hiB counsel and was advised to go right on with his work.He accordingly kept bis men at work carrying the dirt away and doing the grading. It is understood that Mr. Luce takes the ground that he has a perfect right to improve his own property in any way he Bees fit. Chairman Davis of the board of selectmen states that the board would have been perfectly willing to have made some arrangement with Mr. Luce regarding the removal of the earth, but as nothing was said to them no opportunity was given. There promises to be a lively contest all things considered.
