Be had been col* looting in that 'vicinity and was on a spree the day before he was killed. He lived al St. Ansger, Iowa, and his body baa been returned to I hat place. Some money nud valuables were found on his person, so that it ia thought he was act robbed. The iestimony wits a* follows;-Dr, E. W. McCord betng sworn said that he found tbs body of Erick Nelson lying in a stall in OJy Nelson’s stable in Twin Lakes ; on examination found that said Erick Nelson had been fee ruck by some blunl instrument over the left side of the head, bursting the bali of the eye, and that the neck had been fractured between the third and fourth cervical vertebra; supposed to have been (load about fourteen hours,Gil fill on Nelson being sworn said he saw Erick Nelson about 4 o’clock p. at., Oct 30, in Oly Nelson’s saloon talking with Oly Nelson ; said Erick Nelson wished to lie down and deponent took him to the stable for which depouent received a drink uud deponent made a bed for him of hay in the west end of the stable; ou going in to the stable after dark heard deceased breath -l ing naturally ; had not been fighting and had no marks of, violence on his person • no koyscs were loose and none could have got to him to injure biro.Oly Nelson being sworn said: Erick Nelson came to my saloon about 2 o’clock p. m., Oct, 30th, 3879, and called fora axu uf salmon; while eating the name a neighbor, a friend of Uie deceased, whose name is Oly. came iu and called fur two glasses of whiskey ; then . looking around he recognized deceased when lie called for another glass to give deceased which deceased refused, saying he preferred beer. Deceased wished to lie down, saying he hud bad no vest for some days, but refused lo go to bed because he had been on a spree nTfd would prefer sleeping in tlie siable and would give Giifilien 25 cents to take him there, on which Oly Nelson sent his son, Giifilien, with deceased and told Giifilien to make him a good bed of hay. John Nclsou, son of Oly Nelson, told his father on the morning of Oct. 31st that he ran on a dead wan m the siable; on bearing this Oly Nelson and others went to the stable and found deceased. About 5 o'clock a. m. Oct. 31 a stranger came to deponent's hotel and said he had been around the house all night and coaid not get in ; deponent asked him where be came from and he said from Lake Mills ami had been trying all around town to ■find a place to sleep and could get in no where and was forced lt;o steep on a buffalo rube in the alley ; this stranger had blood cm ilia luce and neck, which he washed off as soon as he could, in a dish of dirty water that was on the stove. Deponent-called Thomas Donahue aside and wished hiu\ to lake notice of^he blood on his face and neck ; said stranger went with wever-al others to see deceased and said (lie deceased was Dig Erick, and that he had been on a spree ul Lake Mills for three days.J. 11. II, Smith, coroner of said county, upon viewing the body of Erick Nelson, lying there dead, by the oaths of the jurors whose names arc hereunto subscribed, who, being a worn to inquire on behalf of the state of Minnesota, when, how, and by what moans the said person came to Ida death, upon their oatha do say that the enid Eriek Nelson came to his death by violence from the hands of a party or parties to the undersigned jurors unknown.F McCall,M.
