John Clarke was indiffed for Efeb treafon, (a* not being a perfon employed in his Majctiy’s mint not being lawfully authorized, for hating in hispoflefliun and cufiody, mouldi ami other implements, for counterfeiting the current coin of the realm ; he was alfo indited on two other indictments, for count erf citing halfpence and for hay ing a quantity of fuch counterfeit halfpence su hispoileflion.The firil witnefs on behalf of the profecution was Mr. John Atkinfon, one of the officers of police, who depofed, that on Monday the 16th uiftaot, Alderman James called upon him to accompany him to Dirty-lane, where the prifbner lived, and where he found concealed irf.the pri-foner’s houfe, fcveral counterfeit guineas, halt guineas and halfpence, with dves, a Urge fly, and fcveral implements ufed in coining, that it took twoar loads to carry the implements away, that Clarke was in bed, that they brought Clarke and the implements to the Police-houfe, from whencehe was fern to the New Prifbn, and that Clarkeacknowledged that the houfe where the implements were found was his.Marcus O’Hara, a Police Conftable, proved to the fame cfftCf.Kdward Bates was produced on the part of theprifoncr, whofe tcftiinony went to prove, that theimplements feized were ulcd in the bulincfa which the pnfoner followed, he being a buckle andbutton maker.'Mr. Recorder, who was Counfel for the prifo-ner, obferved, that the evidence before the Jury did not fquare with the charge laid in the iudiifi-ment fitted, that there was found in the poHcflion ol the prifouer, moulds made of fieri, whereas tlic witnellcs produced had only proved that they found dvcs, and of courfe the -jury rouft acip.it him of the indictment for high trcafon, and in fupport of his calc he quotedl the 8th ut Queen Aun.The pnfoner was accordingly acquitted the charge of high trcafon, but he was found guilty on the two other indictments for miidemca-nors.
