IxTERRSTHfO Case.—In tbe Fourth District Court on Friday last, a cose was tried which occupied so omcU time that the Court on the summing up; etc., of tbe case, wanted to go to bed, and therefore ordered the jury to retire and bring in a sealed verdict, wluch’necessarily required every juror to be present in court when the seal was broken, and the verdict read by the Clerk at 10 o’clock ou Saturday morning. * The appointed hour came, the verdict was tiled, and oil the jury were present save one, viz,? Mi. Julius Levy, of St. Loakv, Levy Co* After waiting 'a decent time for absent jurors, tbe Court dispatched the SherilT to fiud Mr. Lery and bring him in.Time fled by—the Sheriff returned and stated to the Court that Mr. Levy was in a Synagogue engaged in the devotioual exercises 'attending the Day of Atonement, and that he absolutely refused to leave the Synagogue, or to appear before the Court until Mouday morning—as he considered that heougbtfirst to obey the higher power to which he obeyed implicit allegiance, before ntteuding to the commands of an iqfe-rior and temporal power. Judge Hager, on hearing this statement, ordered an attachment issue Tor his person, aud that order be eutcr-ed for him to show cause why he should not be punished for contempt of Court.The Sheriff, however, was clothed with discretionary power in regard to tbe service of the attachment, as it was left optional with him whether he should serve it upon Levy, and make the arrest in the Synagogue, and'during divine services, or whether he should wait the termination of the religious exercises and arrest him outside the Synagogue. Tbe Court then ordered a recess until one o'clock.The Sheriff went back to tbe Synagogue, but 31 r. Levy had left it. Upon this state of facts Judge Ilager fined Sir. Levy $500 for contempt of court. Upon a motion being subsequcntlv made to remit the fine, the Judge consented, and stated that he would hear Air. Levy's excuse on Monday, lie stated also that according to law, a Christian must, if necessary, render a verdict on his Sabbath, and that he considered no member or any other sect should be allowed greater privileges.
