Attorney General John Hill has predicted there will be uninterrupted railroad service for shipments of wheat between Winters and Abilene if the Interstate Commerce Commission (ICC) approves a recent decision reached by an administrative law judge. Hill was commenting on a recent initial ruling by Judge Robert E. Joyner in Washington, D. C., denying an application for rail aban donment by Abilene and Southern Railway Company, along with the Texas and Pacific Railway, the parent company. The two lines had sought authority from the ICC to abandon the entire stretch of railroad from Abilene to the end of the line at Winters. That stretch, a distance of about 39 miles, is used primarily by farmers to transport grain to market. “This is an extremely important decision, and one that we trust the ICC will see fit to affirm,” Hill said in a May 24 statement. ‘As noted in this order, there is no effective alternative transportation source for this area, and a higher price for wheat for farmers is available only through shipment by rail.” The Attorney General's Transportation Division, headed by Assistant Attor ney General David Hughes, acting on behalf of the Texas Railroad Commission, vig orously protested the rail road’s attempt at abandon ment in hearings held on the matter last December and February in Winters. “Our position was upheld completely by this decision,” Hill noted, adding that the order clearly states that “every consideration argues against abandonment.”
