Hogan, late of Maynard, in said 'County of Middlesex, deceased, representing that said testatrix bv paragraph numbered ‘*21. of her will devised and bequeathed to each of the children of Joshifa and Rachel Nickerson of Port Norris, New Jersey. .625% of the residue of her estate, and further provided that if any of the legatees under her will be not living at the time of probate of said will, his or her gift should go to his or her “legal heirs”; that Rachael A. Clark, their daughter, died on April 6, 1928. leaving said Joshua Clark, her husband, and live children, said Morton D. Clark, Charles S. Clark, Howard M. Clark, Edward Clark and Doris G. Swift surviving her: and that said petitioner is in doubt as to whether or not said Joshua Clark is a “legal heir” and entitled to receive any part of said legacy; and praying for the instructions of this Court as to whether or not said Joshua Clark, the surviving husband of said Rachel A. Clark, is a “legal heir” of said Rachael A.
