By Becky Kell News Director His hands cradled the top of his head and he stared downward at the table where he sat alone. Nathan W.C. Dukes answered quietly as each of five charges against him was read by Carroll Circuit Judge Joseph Carey at an initial hearing on Monday. Delphi attorney _— Patrick Manahan was appointed to repre sent Dukes, who has _ been charged with Count I, reckless homicide, a Class C felony; Count II, obstruction of justice, a Class D felony; Count III, main taining a common nuisance, a Class D felony; Count IV, posses sion of marijuana, a Class A This demeanor, and Count V, false informing, a Class B misde meanor. Dukes, who turns 23 on Thursday, was taken into custody Friday evening after police responded to a report of a possible shooting at 1113 N. Washington St., Delphi. The affidavit of probable cause revealed that upon arrival, offi cers heard yelling coming from the upstairs of the residence. When they reached “the top of the stairway, they observed that the door was open and a man was yelling for help, holding a female.” Delphi Police Officer Brandon Endicott instructed the man sever al times to put the female down. Endicott reported the face of the female, Kolet R. Flood, age 18, “was bluish in color and there was a hole about three to four inches in diameter above her heart.” Carroll County Sheriff’s Deputy Steve Mullin who filed the affidavit of probable cause, said Endicott “observed blood on Dukes’ upper body and shorts.” A search of the residence revealed a sleeping infant in a car seat carrier was the only other occupant found. A red tub filled with ice and bottles of alcohol were seen near the entrance of the residence, as well as several open containers of alcohol throughout the residence. Officers also reported observing in plain view, a plant-like substance they believe was marijuana and some rolling papers. “In a gutter just outside the door, officers located a wallet, a pipe with burnt residue and a paper towel roll with aluminum foil, wrapped around a quarter sized hole. The wallet belonged to Michel Knoth Jr.,” the affidavit said. Dukes advised police that he, Flood, and the baby were the only ones at the residence at the time of the shooting. He said he and Flood were playing cards. In the affidavit, officers said that Dukes told them he wanted to show Flood modifications he had made to his Mossburg shotgun. “He stated he picked up the gun, and when he went to rack the slide of the barrel, the gun dis charged.” He told police he then called 911. When officers interviewed Knoth, age 20, the affidavit said Knoth told them he had been at the residence when Flood was shot. Knoth said Dukes was “messing around with the gun when he pumped the barrel slide, pointed it at Flood within three to five feet of her and pulled the trig ger.” The affidavit said that Knoth stated that Dubes “threw down the shotgun and told him to leave, and he did so.” Mullin stated in the affidavit that in a later interview, Dubes recanted and told police that Knoth had been at the residence when Flood was shot, and that he told Knoth to leave, hid the wallet and marijuana in the gutter, and then called 911_ Flood, who resided at 1175W 400N, Delphi, died at 11 a.m. Sunday in St. Elizabeth Medical Center, Lafayette. She was the daughter of Mark and Linda Flood and would have graduated Saturday from Delphi Community High School. She leaves behind an infant son. Carroll County Prosecutor Rob Ives asked the court to set bond at $20,000. An omnibus hearing was set for July 28 at 11 a.m., with the trial set tentatively for Aug. 23 at 9 a.m. If convicted on all charges, Dukes faces a maximum of 15 years in prison. Following the circuit court hear ing, Dukes was transferred to Carroll Superior Court on a peti tion for revocation of probation. He wept as he spoke with mem bers of his family, while waiting for the hearing to begin. Deputy Prosecutor Tricia Thompson asked Carroll Superior Judge Jeffery Smith to hold Dubes without bond. Dubes was remanded to the custody of the sheriff and Smith will make a decision during a bond hearing set for May 27 at 1 p.m. Nathan W.C. Dube:
