Cnmplxdl on the l*th of last June, in progress iu this place for the pnst week, resulted in thu conviction of Yarberry of murder in tin* first degree.Al the time of the murder Yarberiy was acting .city marshal ol the new town. He had a few weeks previously been acquitted of theMURDKK OK A YOUNG MAN named Crown, a nephew of ex-Gov. J. C. Brown, of Tennessee.In this Utter case the circumstances in brief were that at night a pistol shot was fired by some drunken man near a saloon. Yarberry, with his accustomed zeal, started to arrest the man. but, probably not knowing the culprit, *aw a man quietly crossing the street and ordered him to throw up bUt hands; not responding, Yarberry and bis depniy open«*d fire upon the unconsctoua man and killed him outright.Campbell evidently did not know he was challenged, but the deb ase broke down in an attempt to prove that Campbell fired at Yarberry and that a pistol was subsequently tound near the dead body, both theories being emphatically disproved by the best evidence.The defense was very ably conductedby Judge Trimble and Col. Chavi*w,and the prosecution by District Attorney A. It. Owen and Col. Win. Breeden, of Santa Fe. The prosecution was irrcsistnble in its force, the argument of Col. Breeden being considered one of the most eloquent and logical ever heard in this territory.The conviction of Yarberry is a substantial victory for the law and order party, and flic death knell of the roughs. A new era of peace and prospeiify opens for Albuquerque.
